Conditions of Carriage

  1. The liability of the carrier under this contract is subject in all respects to the provisions of the Civil Aviation (Carrier's Liability) Act 1959-70 or as amended from time to time and in particular in respect of death or injury is limited to the sum of $500,000 and in respect of baggage is limited to the sum of AUD$1,600 including a maximum of AUD$160 in respect of baggage other than registered baggage.
  2. Each full fare passenger is allowed personal effects of maximum weight of 13kg. Any excess shall be paid for at the applicable rates. The carrier will extend its liability under the above-mentioned Act to a higher sum than AUD$1,600 where the value of the passengers registered baggage has been previously declared and surcharge paid thereon and then only for such declared value or the actual value thereon whichever is lesser. The carrier accepts no liability whatsoever for loss of or damage to any baggage resulting from the inherent defect quality or vice of goods carried or for loss of or damage to registered baggage not collected by the passenger within a period of twelve hours after the arrival of the aircraft at destination.
  3. Airnorth reserves the right to refuse carriage to any person who seeks to travel in violation of any applicable law or tariff or is otherwise in breach of these Conditions of Carriage, or who is under the influence of drugs or alcohol, or it is necessary for the safety or comfort of other passengers or for the protection of property. This extends also to passengers that may have been banned from travelling on any Airnorth flights due to previous incidents relating to the above breaches or violations.
  4. This ticket is not transferable and unless endorsed otherwise is valid for a period of one year from the date of issue and then only for the date, service and passenger specified here on. Refunds will be made at the discretion of the carrier and cancellation fees will be charged as set out in the carrier's published tariff. The passenger must be ready at the airport 45 (Domestic) minutes and 90 minutes (International) before the stated or advertised time and place of departure of the aircraft, otherwise no claim for a refund will be considered. Exact times of departure or arrival are not guaranteed. The carrier reserves the right to decide the suitability or otherwise of meteorological and other conditions for normal performance of a flight and to modify the time and place of departure or landing and route, and accepts no responsibility for making connections.
  5. The passenger shall not take into the aircraft or include in his baggage or goods any explosives, volatile spirits, corrosives, alcoholic liquor, matches (other than safety matches), and any easily ignitable article or any offensive thing likely to cause inconvenience to passengers or anything likely to endanger aircraft, passenger or goods.
  6. If the carrier cannot commence or complete his contract for carriage by air it will, if required by the passenger, forward him as soon as possible to his destination by other available means or refund the fare paid by him for himself and his baggage less the value of any flown mileage. Beyond providing such substituted carriage or refund, the carrier shall be under no further or other liability.
  7. The passenger shall comply with the instructions of the carrier's servants or agents concerning all matters connected with or consequential to the air service, and shall comply with the conditions of this ticket and the terms of any notice exhibited in the aircraft and shall be responsible for any loss or damage occasioned by non-observance of any instructions, conditions or notice.
  8. The passenger shall not enter or remain on the aircraft while his status or mental or physical condition is in the opinion of any servant or agent of the carrier such as to render him incapable of caring for himself or making objectionable to other passengers or involve hazard to himself, other persons or property and the carrier shall not be bound to provide substituted carriage under Clause 6 hereof for a person precluded by reason of this clause from completing his journey. The passenger shall remain seated during taxiing and when required by the carrier during flight. The passenger shall not smoke (except as specifically authorised by the carrier) in or in the vicinity of the aircraft, throw anything from the aircraft or walk in front of the aircraft or in the vicinity of the engines when entering or leaving the aircraft.
  9. The carrier reserves the right to substitute without notice any other aircraft for that originally scheduled or to transfer the passenger without notice to the other aircraft at any intermediate stopping place and all the conditions of this ticket shall remain applicable to such substituted carriage.
  10. The carrier may arrange with any other person or corporation to undertake the carriage hereby contracted for or any part thereof or any service auxiliary thereto including the transportation of the passenger, his baggage and goods to and from any aerodrome or taking off or landing place, and any such person or corporation and his or its servants, agents and the employees shall be entitled to the benefit of these conditions to the same extent as the carrier.
  11. Wheresoever this ticket may have been issued this contract shall be governed and construed in accordance with the laws of the Commonwealth of Australia and any proceedings against the carrier shall be brought in the State or Territory of the first point of departure as per the passenger ticket.
  12. Any ticket issued by Airnorth for carriage over the lines of another air carrier is issued only as an agent of that other air carrier.
  13. The airline does not guarantee it will be able to carry you and your Baggage in accordance with the date and time of the flights specified. Schedules may change and flights may be delayed or cancelled for a range of reasons including but not limited to bad weather, air traffic control delays, strikes, technical disruptions, network changes and late inbound aircraft. Flight times do not form part of your contract of carriage with us. Please ensure accurate passenger details are provided in the booking process so any changes can be notified. To the extent permitted by law, the airline excludes liability for any costs, expenses, losses or damages incurred by the Passenger as a result of failure to meet a schedule.
  14. Carriers name may be abbreviated in the ticket, the full name being set forth in the carriers tariffs, conditions of carriage, regulations, timetables and website.
  15. In these conditions the expression "the carrier" shall mean and include Airnorth its franchisees, servants, agents and employees and other persons or corporation with whom Airnorth may have arranged as in condition 10 hereof mentioned and his or its servants, agents or employees and the expression "the passenger" shall mean the passenger to whom this ticket is issued or who is carried by virtue of the issue thereof. Words importing the singular or plural number or the masculine or feminine gender shall, where the context permits, include the plural or singular of the feminine or masculine gender as the case may be.
